RiskTrends™ Trusted Insight Podcast: Billion Dollar Verdict Highlights Negligent Retention Risks For Employers

On the November 18, 2022, RiskTrends™ Trusted Insight podcast, attorneys Jack McCalmon, Leslie Zieren, and Emily Brodzinski examined $1.1 billion-dollar jury verdict award against Charter Spectrum, arising out of the murder of an elderly customer by a Charter Spectrum employee. Charter Spectrum was previously ordered to pay $7 billion in punitive damages for gross negligence in the supervision/retention of the employee, and for its claimed forgery of an after-the-fact arbitration agreement, in an attempt to cap damages. The trio discussed customer safety, background checks, cover ups, and negligent retention.

At the beginning of the 20-minute podcast, the trio addressed a question generated by the previous podcast: "Can/should an employer put a video camera in an employee's home office?"
